Terms and Conditions

The owner of the online store elbe.ee (hereinafter referred to as the Online Store) is Elbe Engineering OÜ (registration code 11475976), located at Tööstuse tee 2, Tõrvandi village, Kambja municipality, Tartu County 61715.

Validity of the sales contract, product, and price information

The terms and conditions apply to purchases made in the Online Store.

The prices of the products sold in the Online Store are indicated next to the products. An additional fee for the delivery of goods will be added to the price. All prices of the goods sold in the Online Store are in euros.

The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer when placing the order.
Information about the goods is provided in the Online Store directly next to the product.

Placing an order

To order a product, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled in, and the appropriate delivery method must be selected.

The amount to be paid will then be displayed on the screen, and it can be paid securely via the following payment methods:

  • Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Bank, Citadel
  • Visa/Mastercard card payments

Payments are processed by Montonio Finance UAB.

The owner of the Online Store is the controller of personal data and forwards the necessary personal data for making payments to the authorized processor, Montonio Finance UAB.

If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded without delay but no later than within 14 days of sending the notification.

Delivery

Goods are delivered worldwide.

The buyer has the following options for receiving the goods: UPS or the possibility of collecting the goods personally.

The shipping costs are borne by the buyer, and the corresponding price information is displayed next to the shipping method.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.

Note! Depending on the products, the buyer may not have the right of withdrawal. In such cases, the relevant products and services must be listed, and they must comply with the conditions listed in § 53 (4) of the Law of Obligations Act.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of return, the ordered goods must not be used for purposes other than necessary to verify the nature, characteristics, and functioning of the goods in a manner similar to how it would be possible in a physical store.

If the goods have been used for purposes other than those necessary to verify their nature, characteristics, and functioning, or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount in proportion to the decrease in the value of the goods.

The cost of returning the goods is borne by the buyer unless the reason for the return is that the item being returned does not match the order (e.g., wrong or defective item).

The buyer must return the goods within 14 days of submitting the withdrawal request or provide proof that they have handed over the goods to the carrier within the specified period.

Upon receiving the returned goods, the Online Store will refund the buyer immediately but no later than within 14 days from the receipt of the withdrawal request all payments received from the buyer under the contract.

The Online Store may withhold the refund until the item that is the subject of the contract has been returned or until the buyer provides proof that they have returned the item, whichever occurs first.

If the buyer has explicitly chosen a delivery method that differs from the least expensive usual delivery method offered by the Online Store, the Online Store is not obligated to refund the cost that exceeds the cost of the usual delivery method.

The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the Online Store has been significantly lower than the market price due to an error.

Right to file a complaint

The Online Store is liable for any lack of conformity or defects in the goods sold to the buyer that were present at the time of delivery and which become apparent within two years of the goods being handed over to the buyer. For the first year after delivery, it is presumed that the defect existed at the time of delivery. Rebutting this presumption is the responsibility of the Online Store.

The buyer has the right to contact the Online Store regarding a defect no later than two months after the defect has been discovered, by sending an email to shop@elbe.ee or calling +372 5204688.

The Online Store is not liable for defects that arise after the goods have been handed over to the buyer.

If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all fees associated with the sales contract.

The Online Store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.

Direct marketing and personal data processing

The Online Store uses the personal data entered by the buyer only for processing the order and delivering the goods to the buyer. The Online Store forwards personal data to companies providing delivery services to deliver the goods.

The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed a wish to receive such notifications by entering their email address on the website and indicating their desire to receive direct marketing messages.

The buyer can at any time opt out of offers and newsletters sent to their email by notifying us via email or by following the instructions included in the offer-containing email.

Dispute resolution

If the buyer has any complaints regarding the Online Store, they should be sent to the email address shop@elbe.ee or call +372 5204688.

If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The procedure conditions can be reviewed and a complaint can be submitted here. The Consumer Disputes Committee is authorized to resolve disputes arising from contracts concluded between the buyer and the Online Store. Reviewing a buyer’s complaint in the committee is free of charge.

The buyer can also turn to the European Union’s online dispute resolution platform.
